Residents say they're unsightly and unsafe. County Code Compliance is working to get property owners to remove the carts, but at least for now many of those carts will sit untouched. It may look like a grocery store cart corral, but a vacant lot is one of three in east Bakersfield that is home to dozens of abandoned shopping carts. "They just pile up every day," said Emilil Joven who lives nearby. "They never go anywhere. Every day it starts with one or two, and the next day there's 10, 20, 30." Residents say this makes the neighborhood look bad. "I think it looks like the place for elephants go to die," said Phil Tyrwhitt of east Bakersfield. "Kids play with them and get their fingers smashed, so yeah they need to be moved," said Shawanda Brownlee of southwest Bakersfield. Some of the carts are even coming from a mile away. "We contacted the companies, Walmart, Target, Foods Co. and they never come pick them up," said Joven. "They send no one to pick these up." 17 News contacted California Shopping Cart Retrieval Corporation, a company that picks up abandoned carts for stores at a price. It said it will pick up some of the carts but not all of them because Walmart and Dollar General on this side of town won't pay the company $3 a cart for pickup. "I'm not going to drive around for free and pick up carts for these folks," said Brian Raymond, Director of Operations for California Shopping Cart Retrieval Corporation. Ultimately, the responsibility falls on the property owner. County Code Compliance said it sent the owner of the property on Flower Street and Virginia Street a notice that if the lot isn't cleaned up in 30 days, there will be a fine. Until then, residents will have to live with the congregation of carts. "I think it's a shame we can't keep it a little cleaner," said Tyrwhitt. Code Compliance points out each of these locations with the carts has a can collecting station nearby. Posted: Friday May-24-2013 7:45 PMKGET Channel 17 Bakersfield NewsJudge Keeps Sentences The Same In Elderly Couple Murder Case![]() BAKERSFIELD, CA - A Bakersfield judge ruled Friday afternoon not to change the sentences of two men convicted of murdering an elderly couple in 2008. 81-year-old Joseph Parrott and his 77-year-old wife, Dorothy, were found murdered in their southwest Bakersfield home. On Friday, Judge John Somers said this was one of the worst murder cases he's ever seen. Defendants Kyle Hoffman and Luis Palafox both sat quiet in the courtroom with little reaction. Police say in 2008, Hoffman and Palafox killed the Parrotts in their home while they slept. Prosecutors say it started with an attempted robbery, and when the two found the elderly couple sleeping, they stabbed and beat them. Both men were 16 when they committed the murders. Friday afternoon, Judge Somers decided not to reduce their sentences of life in prison without the possibility of parole. This comes after a U.S. Supreme Court ruling last year imposed stricter rules on no-parole sentencing for juveniles. "I think the judge did the right thing," said Deputy District Attorney David Zulfa. "I think he was deliberate in his analysis and exercising his discretion and at the end of the day, I think the life without parole sentences were appropriate given the vicious nature of this crime." "It's not unexpected due to the horrible nature of the crime," said Michael Lukehart, representing Luis Palafox. "That is something that every party had to acknowledge." "The only thing I'd say is that we're disappointed in the court's decision. I'm glad that Mr. Hoffman got to say again that he's sorry and that nothing he will ever say will forgive the terrible things he did," said T. Alan Rogers, representing Kyle Hoffman. The Supreme Court ruling said juveniles can be sentenced to no-parole prison terms only if the judge determines the sentence is appropriate. Judge Somers said he still believes Hoffman and Palafox are a danger to the community. Under the court ruling, their new sentences could have been 25 years to life. It will be the third investigation into Silva's in-custody death, following the Kern County Sheriff's Department's and the FBI's. District Attorney Lisa Green said it won't be a speedy process. She will wait for the FBI to complete its investigation, which could take four to eight weeks. "We came to that decision on our own, under the authority that I have as the chief law enforcement officer in the county," explained Green. Green said she decided to review the Silva case before Sheriff Donny Youngblood invited her office to investigate. "We will request all of the reports and interviews from the Sheriff's Department, 911 tapes, photos, autopsy," said Green. "We are going to wait for the FBI to complete their investigation and review the materials they provide us from their investigation," she continued. At a news conference Thursday, Sheriff Youngblood said Silva put up a violent struggle the night he died. "One of the Highway Patrol officers in this case has been on 12 1/2 years and he said this is one of the most violent resisting arrests he has seen," noted Youngblood. The pathologist found drugs in Silva's system. He found two uppers and two downers. He ruled Silva's death an accident. Youngblood said Silva was hobbled when his heart stopped. Silva's hands were handcuffed and his feet were tied together. "You have to do what you have to do to keep someone from hurting themselves as well as hurting officers. We want to go home at night as well," explained Youngblood. Between Silva's screams the night he died, you hear calls to get the hobble. The hobbling technique is used by officers to arrest and control a defiant suspect. "The suspects are quite often under the influence of narcotics or alcohol or some other kind of substance and you put that in the mix, it increases the likelihood they will have medical complications," said Scott Loggins, Senior Law Enforcement Consultant with California Commission on Peace Officer Standards and Training. The California Commission on Peace Officer Standards and Training is also known as POST. The statewide organization oversees all training for California peace officers. Loggins said officers are required to have 60 hours of arrest and control training, but each law enforcement agency uses different techniques. "Some agencies are a little more restrictive with regard to use of force and some give the officers more latitude," he explained. Youngblood said the deputies involved in Silva's arrest have been cleared to return to duty. No word on when that will happen. On Friday, they updated the number on the sign leading up to the Kern River, adding another drowning from 2012. The river is very low, but team members say that can be just as dangerous as when it's high. People become less intimidated and get into trouble and there are more exposed rocks. The "Killer Kern" lived up to its infamous nickname in 2012. 267 people have died in the river since 1968. The latest was a man last July who lived along the river near Hart Part. "Apparently, he fell in after he'd been drinking with friends," said Sgt. Ken Smith, Kern County Search and Rescue. Search and Rescue teams updated the sign, as they do every year, as a safety reminder. Still, every year people get into trouble. "The river is relentless," said volunteer, Bob Fallon. "It's not like the ocean where you have an ebb and flow of tides. The river constantly flows." But, that flow is down. Rescuers say that's likely why they had only one death last year compared to nine deaths in 2011. "In 2011, this same date, the Friday before Memorial Day weekend, the river was flowing at 3,800 cubic feet a second, which is basically like 3,800 basketballs flowing at you in a confined area in a second," explained Sgt. Smith. Sgt. Smith said, in 2012, the river was down to 1,145 cubic feet per second. Today, it's flowing at 545 cubic feet per second. The low flow still creates high risk. While the rapids aren't as raging, the current is still strong, and boulders once buried in water, are visible for rock hoppers. "Our missions will be for people who have fallen off the rocks, hit their head, and either lost consciousness and drown or are so damaged and broken we have to get them across the river and up the side of the hill," said Sgt. Smith. Their message is respect the river at all levels or our beautiful resource could turn ugly. "That would be the best gift for any of us to have nothing go up on the sign and just talk about safety," said Fallon. Rescuers say wear a life vest, helmet, and rubber shoes if you plan on getting in the river. And, never drink and swim. Sgt. Smith says 98 percent of their victims are men. and about half of their victims are local. A Kern County judge decided Friday his original sentence for Kyle Hoffman and Luis Palafox of life in prison without the possibility of parole would stand for the grisly murders of an elderly couple whose home they broke into the night of Aug. 4, 2008. The two had been found guilty of the murders of Dorothy and Joseph Parrott and were previously sentenced to life without parole in 2010, but a decision last year by the U.S. Supreme Court said state and federal laws can't automatically impose a sentence of life without parole on juveniles and that judges must consider the offenders' age and other factors before imposing that sentence. The English and Spanish signs at the entrance to the Kern River Canyon were changed Friday to add one more life lost in the Kern River since 1968. As Kern County Sheriff's Sgt. Ken Smith added a number seven at the end of last year's number of 266, nearly 15 Search and Rescue personnel and Kern County Fire Department firefighters all looked up at the new number of 267 lives lost. Kern County District Attorney Lisa Green tells 17 News her office will conduct an independent review of the in-custody death of inmate David Silva, once the Sheriff's Department and the FBI conclude their investigations.
Comments?Green sat down with reporter Kelsey Thomas and made the following statements. "We had made the decision to review it, prior to the Sheriff's press conference. We came to that decision on our own, under the authority that I have as the chief law enforcement officer in the county. Frankly, most of the people don't know very much about this case and I think they look to the office, for us to, reach a just result. We will review it and come to whatever conclusion we come to. I just think that this is the case the citizens of the county don't really know a lot about other than what's come out in the media and they look to this office and me to exercise our discretion and review it and that's what we're going to do . Our review will be to see if there's any violation of state law. I have not seen one report. I actually have not watched any of the videos which have been out there and so it's hard for me to speculate what that might mean. I think that people have a lot of questions and it's incumbent on me, the district attorney, to look at this and hopefully everyone's questions will be answered after our review is concluded." BAKERSFIELD, CA - The Centers for Disease Control and Prevention reports almost 800,000 people in the United States have a stroke every year. Statistics show the majority of people can't identify the symptoms.
Comments?May is National Stroke Awareness Month. One local survivor says having a stroke was a huge wake-up call. Last November, Bob Tyner was headed to Las Vegas when he started having trouble eating. Feeling that something wasn't right, he evaluated his symptoms. "I started assessing myself in the reviewer mirror, and realized, I couldn't blink, I couldn't wink, the left side of my face wouldn't work and I realized at that point I probably was in a serious place," said Tyner. Tyner was having a stroke. He spent the next several days in the hospital. "At that point I had to make some changes. I had a lot of changes going on in my life that were outside of my control, but I needed to make some changes that I could control," Tyner said. Tyner says he lived a high-stress life, working two full time jobs, drinking three six packs of diet soda a day and being overweight. Now, Tyner has settled into a job he enjoys, stopped drinking soda, and has lost about 80 pounds. "I think I have a life now. I think, medically, I feel better because I have time to do things I want to do," said Tyner. He monitors his sleep, calorie intake, and exercise through an electronic bracelet synced to his smart phone. Tyner also consistently takes his blood pressure medication, something he says he didn't do before the stroke. Tyner said, "I took control and took the skills I have to become healthy and that's something everybody can do if they choose to do it." Symptoms of stroke are sudden numbness or weakness in the face, arm or leg, confusion or trouble speaking or understanding others, trouble seeing in one or both eyes, dizziness or trouble walking and severe headache. Experts say anyone experiencing symptoms should call 911. Bakersfield Police Chief Greg Williamson reiterated his stance against police citizen review boards during an appearance Friday on "First Look with Scott Cox." He noted that a lot of cities that have them have been commanded by higher authorities to establish them.
